Terms of Service

1. Acceptance of Terms

By accessing and using the Community PBX system operated by NexusNet, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Community PBX is a FreePBX-based communication system that provides voice and video calling services, voicemail, wake-up calls, and other telecommunications features to our community members. Our system includes:

  • Internal extension-to-extension calling
  • Outbound calling via PSTN (Public Switched Telephone Network)
  • Inbound calling capabilities
  • AliX network integration (276-NXXX block)
  • G722 audio and H.264 video quality
  • Voicemail and wake-up call services

3. Prohibited Uses

By using our Community PBX system, you explicitly agree to the following restrictions:

3.1 Malicious Intent

You agree NOT to use the system for malicious intent, including but not limited to:

  • Harassment, threats, or intimidation of any individual or organization
  • Fraudulent activities or impersonation
  • Distribution of malware, viruses, or harmful content
  • Any activity intended to harm, disrupt, or compromise our network or other users
  • Illegal activities of any nature

3.2 PSTN Abuse

You agree NOT to abuse the outbound PSTN (Public Switched Telephone Network), including:

  • Making excessive or unnecessary calls that burden the network
  • Robocalling, spam calling, or automated dialing without consent
  • Prank calls, nuisance calls, or harassment via telephone
  • Attempting to bypass call restrictions or limitations
  • Using the service for commercial telemarketing without authorization
  • Making calls to premium rate numbers or international destinations without permission

3.3 Network Abuse

You agree NOT to abuse our network, including:

  • Attempting to gain unauthorized access to system resources
  • Overloading the network with excessive traffic or connections
  • Interfering with other users' service or network performance
  • Attempting to reverse engineer, hack, or compromise system security
  • Sharing account credentials or allowing unauthorized access
  • Using the service in ways that violate applicable laws or regulations

4. Emergency Services (E911) Limitations

IMPORTANT NOTICE: Community PBX does NOT support E911 (Enhanced Emergency Services) calls.

4.1 E911 Service Unavailable

Our Community PBX system does not provide E911 emergency calling services, which means:

  • We do NOT comply with Kari's Law regarding direct dialing to emergency services
  • E911 services require a fixed physical address for each user, which is not feasible for our multi-member community system
  • Emergency calls (911) made through our system may not connect properly or provide accurate location information to emergency responders
  • You should NOT rely on Community PBX for emergency communications

4.2 Emergency Communication Alternatives

For emergency situations, you must use alternative communication methods:

  • Use a traditional landline or cellular phone to dial 911
  • Ensure you have reliable backup communication methods available
  • Do not depend on Community PBX as your primary or sole means of emergency communication
  • Inform household members and colleagues about these limitations

4.3 Future E911 Support (Coming Soon)

Personal Trunk Integration:

  • We are developing a feature that will allow you to bring your own SIP trunks to our system
  • If you connect your own trunk service that provides E911, those emergency services will be available through your personal trunk
  • This feature is currently in development and will be announced when available
  • E911 compliance through personal trunks will be your responsibility, not Community PBX's

5. Account Responsibilities

As a Community PBX user, you are responsible for:

  • Maintaining the confidentiality of your extension and account information
  • All activities that occur under your account or extension
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your contact information remains current and accurate
  • Complying with all applicable laws and regulations in your jurisdiction

6. Service Availability

While we strive to maintain 24/7 service availability, Community PBX is provided on an "as-is" basis. We do not guarantee uninterrupted service and reserve the right to:

  • Perform maintenance that may temporarily interrupt service
  • Modify or discontinue features with reasonable notice
  • Suspend or terminate accounts that violate these terms
  • Implement usage limits or restrictions as necessary

7. Enforcement and Violations

Violations of these terms may result in:

  • Warning: First-time minor violations may receive a warning
  • Service Restriction: Temporary limitation of calling privileges
  • Account Suspension: Temporary suspension of all services
  • Account Termination: Permanent removal from the Community PBX system
  • Legal Action: Referral to appropriate authorities for illegal activities

We reserve the right to investigate any reported violations and take appropriate action at our sole discretion.

8. Limitation of Liability

Community PBX and NexusNet shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, including but not limited to damages for loss of profits, use, data, or other intangibles.

9. Privacy and Recording

Your use of Community PBX is also governed by our Privacy Policy, which details our call recording practices and data handling procedures.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the user's local jurisdiction. Any disputes arising from these terms shall be resolved in the courts of competent jurisdiction in the user's local area, unless otherwise required by applicable law.
